Selling a Property?

If however you are new to the process you may find the following overview useful. The system in France. In France the Estate Agency business is highly regulated by the government. In consequence the only people, apart from the property owner, who are allowed to offer properties for sale have to be licenced by the Prefecture (the government's office in the department), need to have and display a financial guarantee, and have to have a 'Mandat de Vente', signed by the property owner. This mandat details the owner's name & address, the address and land registry reference of the property being sold, the sale price and the amount and method of calculation of the commission payment (if and when the property is sold) and the minimum and maximum length of the agreement. There are two principle types of sales mandates - simple and exclusive - as follows: Simple mandate. This has been the traditional type of agreement used by smaller local French agents. Under this arrangement you, the seller, can have multiple agencies trying to sell your property - and you can even sell it yourself in competition to the agencies and therefore avoid having to pay their commission if you are successful. However this is really not as advantageous as it sounds. In particular : Agents try to hide the location of the property in their window and web advertising to prevent potential buyers discovering where the property is and contacting you, the seller, direct. This often means that the best or unique features of your house are not included in the advertising material to try to preserve the anonimity of the property. Agents will not reveal the location of your property to clients unless they are prepared to sign a 'bon de visite' (which requires a formal accompanied visit to take place), which effectively locks that client into that agent. In practice this means that far fewer people will have the opportunity to actually visit - or even drive past - your house because of constraints on the agents available visiting time. Although it might at first seem that the exposure of your property is increased by placing it with multiple agents, in practice any potential purchase researching properties to buy in the area, either through personal visit or via internet, will always visit the offices and/or websites of all agents covering that area. Agents on 'simple' mandates do not tend to put as much effort in promoting your property, as they regard it as statistically likely that the property will be sold by another agent. Conversely the commission charges are usually higher than for an exclusive mandate to compensate for sales 'lost' to other agents. There is a high proportion of sales made direct by the vendor that are contested through the courts by an agent who has a simple mandat, even if this is the fault of the purchaser who, previously having signed a 'bon de visite' with the agent, and attempted to circumvent the agent and deal directly with the vendor. Exclusive mandat. This has the advantage of giving one agent the opportunity of selling your property for a fixed length of time (usually 6 months or less) giving them the incentive to put in the maximum possible amount of effort to sell your property within the period of exclusivity. Typically this involves the agent in additional expense but ensures that the greatest number of potential purchasers can see your property, either directly or via a detailed website presentation.
